All of our products are made by Dessertopia and are subject to the following Terms and Conditions.

Ingredients
All ingredients that are in our desserts contain wheat, dairy, eggs and may also come in contact with tree nuts. It is the responsiblity of the customer to inform Dessertopia of any allergies at the time of ordering. Dessertopia is not held responsible for any allergic reaction due to the consumption of our desserts.

Custom Orders
Dessertopia requires a two-week (14 day) notice for large orders and a 5 to 7 day notice for small orders. Where availability permits, orders made on short notice (24 hours or less) may be accepted. If you're requesting a photo or edible image on your cake we will do our best in reproducing that photo or image but it may not be exactly like the original as we make no claim for exact duplication of someone else's work. Also because of the temperature of the weather in Houston, Texas, there may be some color changes to the buttercream on your cake and for this, Dessertopia is not responsible. If you are providing any decorations, fresh flowers, cake toppers, etcetera, for your cake, please bring them in or have them mailed to me at least 2 days before your pick up or delivery date. When customizing an order or inquiring about a price quote, fill out the "Custom Inquiry" form under CUSTOM CAKES at the top of the page and please be very specific with the details as possible. Include the number of servings you will need, flavor of cake, type of icing, colors, theme, spellings of name(s), type of decorations, etc. We will get back with you on your price quote as soon as possible.

Care and Handling
Dessertopia is not responsible for any damages to any dessert after pick-up or delivery is complete. Some cakes may be heavy so it is important to have a stable and secure (preferably a flat surface) space in your vehicle or at the event venue in order for your dessert not to be damaged. We store our products in the refrigerator at 40 degrees, so it is important that once you receive your product that you make sure the product is returned to refrigeration upon arriving at its destination. If your desserts are being delivered to a venue, please make sure the temperature in the room is at least 75 degrees. Do not leave your cake to sit in a warm or hot car as this will cause the buttercream to melt. For a more enjoyable experience please allow your cake to come to room temperature (78 degrees Fahrenheit) before serving. This may take up to 2 hours depending on if your event is indoors or outdoors.

Delivery/Curbside/Pick-up
Dessertopia is a cottage bakery located near the NRG Stadium in Houston, Texas and currently we do not offer shipping. Delivery is an option for orders with a minimum of $100, plus delivery fee for up to 10 miles and for orders with a minimum of $200, plus delivery fee for up to 20 miles. Our delivery fees can vary, starting at $25, depending on your location. Delivery hours are Monday through Friday 9:00am-4:00pm, Saturdays 8:00am-1:00pm. Dessertopia has a limited delivery availability so pick-up is greatly encouraged/preferred. Pick-up times are Monday through Friday 9:00am-6:00pm, Saturdays 8:00am-12:00pm. Call or text when you're on your way and upon arriving your desserts will be brought out to you.

Deposits, Payments, Refunds, Cancellations
All major credit/debit cards are accepted. A deposit of 50% (non-refundable) is due on large dessert orders/custom cakes in order for them to be started on and remaining balances are due one week before the date the order is requested/delivered. Payment is due in full for small or non-custom items ordered online at the time of purchase. If for some reason you are not satisfied with your order, notify Dessertopia within 24 hours and we will give you a refund if 75% of the uneaten product is returned within 24 hours on all orders, large or small, minus the 50% deposit made on large orders and custom cakes and minus 25%, (the cost of ingredients) on small orders. If it has been more than 24 hours you will only receive credit on your next order. Refunds are given within 7 days. All cancellations must be made within 5 days prior to your scheduled pickup or delivery date. After 5 days only 50% of your order can be refunded due to the cost incurred in the purchasing of the ingredients and preparation of your order. Exceptions may apply. (Death, illness, natural disaster)

Changes to Orders
You may make reasonable changes (colors of icing, types of icings/fillings) to your custom dessert order up to 4-5 days prior to your scheduled pickup or delivery date. There will be a $15 change order fee if there are any changes made 3 days prior to your scheduled pickup or delivery date. Please give us a 3 day notice if you wish to postpone your custom cake order for a later date.

Photo Release
We reserve the right to take our own photos of your dessert(s) to use for marketing and promotional purposes without compensation to you.
